Time has been considered a crucial factor in distinguishing between two levels of self-awareness: the “core,” or “minimal self,” and the “extended,” or “narrative self.” Herein, I focus on this last concept of the self and, in particular, on the relationship between the narrative self and language. In opposition to the claim that the narrative self is a linguistic construction, my idea is that it is created by the functioning of mental time travel, that is, the faculty of human beings (...) to project themselves mentally backwards in time to relive, or forward to anticipate, events. Moreover, I propose that narrative language itself should be considered a product of a core brain network that includes mechanisms, such as mental time travel, mindreading, and visuo-spatial systems. Human beings frequently attribute anthropomorphic features, motivations and behaviors to animals, artifacts, and natural phenomena. Historically, many interpretations of this attitude have been provided within different disciplines. What most interpretations have in common is distinguishing children’s manifestations of this attitude, which are considered “natural,” from adults’ occurrences, which must be explained by resorting to particular circumstances. In this article, I argue that anthropomorphism is not grounded in specific belief systems but rather in interaction. In interaction, a non-human entity assumes a (...) place that generally is attributed to a human interlocutor, which means that it is independent of the beliefs that people may have about the nature and features of the entities that are anthropomorphized. This perspective allows us to explain the problems that emerge if we consider anthropomorphism as a belief: (i) adults under certain circumstances may anthropomorphize entities even if they perfectly know that these entities have no mental life; (ii) according to the situation, the same entity may be anthropomorphized or treated as an object; (iii) there is no consistency among the entities that are anthropomorphized; (iv) there is individual variability in anthropomorphization, and this variability derives from affective states rather than from different degrees of knowledge about the entity that is anthropomorphized or greater or lesser naivety of the person who anthropomorphizes. From this perspective, anthropomorphism is a basic human attitude that begins in infants and persists throughout life. The difference between adults and children is not qualitative but rather a matter of complexity. (shrink)

Contemporary semantic theories can be classified along two dimensions: (i) the way and time-course in which contextual factors influence sentence truth-conditions; and (ii) whether and to what extent comprehension involves sensory, motor and emotional processes. In order to explore this theoretical space, our ERP study investigates the time-course of the interaction between the lexically specified telic component of a noun (the function of the object to which the noun refers to, e.g., a funnel is generally used to pour liquids into (...) containers) and an ad-hoc affordance contextually induced by the situation described in the discourse. We found that, if preceded by a neutral discourse context, a verb incongruent with the noun’s telic component as in “She uses the funnel to hang her coat” elicited an enhanced N400 compared to a congruent verb as in “She uses the funnel to pour water into a container”. However, if the situation introduced in the preceding discourse induced a new function for the object as an ad-hoc affordance (e.g., the funnel is glued to the wall and the agent wants to hang the coat), we observed a crossing-over regarding the direction of the N400 effect: comparing the ad-hoc affordance-inducing context with the neutral context, the N400 for the incongruent verb was significantly reduced, whereas the N400 for the congruent verb was significantly enhanced. We explain these results as a consequence of the incorporation of the contextually triggered ad-hoc affordance into the meaning of the noun. Combining these results with an analysis of semantic similarity values between test sentences and contexts, we argue that one possibility is that the incorporation of an ad-hoc affordance may be explained on the basis of the mental simulation of concurrent motor information. In The Leviathan in the state theory of Thomas Hobbes, Carl Schmitt puts forward the claim that there is a ?barely visible crack? in Hobbes's theory of the state that opened the door to liberal constitutionalism. This essay claims that Schmitt's ?thesis of the crack? is composed of two elements: first, Schmitt argues that Hobbes makes a concession to individual conscience in his discussion of miracles; second, Schmitt points out that Hobbes's individualism undermines his notion of the absolute state. As (...) Schmitt relies on an unconvincing critique of Hobbes's discourse on miracles in order to justify his more general claim against Hobbes's authoritarianism, this essay suggests that Schmitt's ?thesis of the crack? is untenable in the form that Schmitt presented it in 1938. An attempt, however, is made to salvage ?the thesis of the crack? by turning to concepts found in Schmitt's Concept of the political and in Political theology. Although Schmitt openly approved of the so?called protection/obedience principle, this essay claims that there are a number of crucial differences between Schmitt's formulation of that principle and Hobbes's own version; an examination of these differences enables us (i) to appreciate the consequences of Hobbes's individualism on his theory of the state and (ii) to shed new light on Howard Warrender's famous claim that Hobbes's sovereign is inherently weak. The essay concludes that in spite of Schmitt's fallacious formulation of the ?thesis of the crack? of 1938, his political theory affords us a rare vantage point from which we can clearly see a case against the association of Hobbes with authoritarianism. Models of discourse and narration elaborated within the classical compositional framework have been characterized as bottom-up models, according to which discourse analysis proceeds incrementally, from phrase and sentence local meaning to discourse global meaning. In this paper we will argue against these models. Assuming as a case study the issue of discourse coherence, we suggest that the assessment of coherence is a top-down process, in which the construction of a situational interpretation at the global meaning level guides local meaning analysis. In support of our hypothesis, we explore the role of executive functions (brain functions involved in planning and organization of goal-oriented behaviors) in coherence’s establishment, discussing the results of several studies on narrative abilities of patients with brain injuries. We suggest that, compared to other models of discourse processing focused on comprehension, our model is a viable candidate for an integrated account of discourse comprehension and production. Although organizational and situational factors have been found to predict burnout, not everyone employed at the same workplace develops it, suggesting that becoming burnt out is a complex, multifaceted phenomenon. The aim of this study was to elucidate perceptions of conscience, stress of conscience, moral sensitivity, social support and resilience among two groups of health care personnel from the same workplaces, one group on sick leave owing to medically assessed burnout (n = 20) and one group who showed no indications (...) of burnout (n = 20). The results showed that higher levels of stress of conscience, a perception of conscience as a burden, having to deaden one’s conscience in order to keep working in health care and perceiving a lack of support characterized the burnout group. Lower levels of stress of conscience, looking on life with forbearance, a perception of conscience as an asset and perceiving support from organizations and those around them (social support) characterized the non-burnout group. What are the affordances of artifacts? One view is that the affordances of artifacts, just as the affordances of natural objects, pertain to possible ways in which they can be manipulated. Another view maintains that, given that artifacts are sociocultural objects, their affordances pertain primarily to their culturally-derived function. Whereas some have tried to provide a unifying notion of affordance to capture both aspects, here I argue that they should be kept separate. In this paper, I introduce a distinction between (...) standard affordances, which concern the function of artifacts, and ad-hoc affordances, which refer to how artifacts are manipulated. I then argue for the neuropsychological plausibility of such a distinction, linking it to the dissociation between function knowledge and manipulation knowledge. Finally, I defend the equal status of these forms of knowledge and, hence, of standard and ad-hoc affordances, and I show that this has some implications for the debate on the role of motor processes in the conceptual knowledge of artifacts. In this article we present the bases for a computational theory of the cognitive processes underlying human communication. The core of the article is devoted to the analysis of the phases in which the process of comprehension of a communicative act can be logically divided: (1) literal meaning, where the reconstruction of the mental states literally expressed by the actor takes place: (2) speaker's meaning, where the partner reconstructs the communicative intentions of the actor; (3) communicative effect, where the partner (...) possibly modifies his own beliefs and intentions; (4) reaction, where the intentions for the generation of the response are produced; and (5) response, where an overt response is constructed. The model appears to be compatible with relevant facts about human behavior. Our hypothesis is that, through communication, an actor tries to exploit the motivational structures of a partner so that the desired goal is generated. A second point is that social behavior requires that cooperation be maintained at some level. In the case of communication, cooperation is, in general, pursued even when the partner does not adhere to the actor's goals, and therefore no cooperation occurs at the behavioral level. This important distinction is reflected in the two kinds of game we introduce to account for communication. The main concept implied in communication is that two agents overtly reach a situation of shared mental states. Our model deals with sharedness through two primitives: shared beliefs and communicative intentions. (shrink)

The aggregation of individual judgments on logically interconnected propositions into a collective decision on the same propositions is called judgment aggregation. Literature in social choice and political theory has claimed that judgment aggregation raises serious concerns. For example, consider a set of premises and a conclusion where the latter is logically equivalent to the former. When majority voting is applied to some propositions (the premises) it may give a different outcome than majority voting applied to another set of propositions (the (...) conclusion). This problem is known as the discursive dilemma (or paradox). The discursive dilemma is a serious problem since it is not clear whether a collective outcome exists in these cases, and if it does, what it is like. Moreover, the two suggested escape-routes from the paradox—the so-called premise-based procedure and the conclusion-based procedure—are not, as I will show, satisfactory methods for group decision-making. In this paper I introduce a new aggregation procedure inspired by an operator defined in artificial intelligence in order to merge belief bases. The result is that we do not need to worry about paradoxical outcomes, since these arise only when inconsistent collective judgments are not ruled out from the set of possible solutions. (shrink)

Research in ethical AI has made strides in quantitative expression of ethical values such as fairness, transparency, and privacy. Here we contribute to this effort by proposing a new family of metrics called “decisional value scores” (DVS). DVSs are scores assigned to a system based on whether the decisions it makes meet or fail to meet a particular standard (either individually, in total, or as a ratio or average over decisions made). Advantages of DVS include greater discrimination capacity between types (...) of ethically relevant decisions and facilitation of ethical comparisons between decisions and decision-making systems, including across different modalities (for instance: human, machine, or coupled human–machine systems). After clarifying ambiguities in the concept of “decision” itself, including the question of how to individuate the decisions made by a system, we discuss the role and meaning of “decision” in common AI and machine learning approaches such as decision trees, neural networks, SVMs, and unsupervised classifiers. We then show how DVSs may be defined for several ethical values of interest, with an extended discussion of transparency. Finally, we explore how such metrics can be applied to real decision-making systems through two case studies: evaluations of LLMs for transparency; and evaluations of criminal risk assessment tools for utility, rights violations, fairness, and transparency. This study explores the relation between pain sensitivity and the cognitive processing of words. 130 participants evaluated the pain-relatedness of a total of 600 two-syllabic nouns, and subsequently reported on their own pain sensitivity. The results demonstrate that pain-sensitive people (based on their self-report) associate words more strongly with pain than less sensitive people. In particular, concrete nouns like syringe, wound, knife, and cactus, are considered to be more pain-related for those who are more pain-sensitive. We discuss our results in (...) the light of three theoretical frameworks – cognitive bias, prototype theory, embodied account. We argue that the latter is best suited to explain the results of this study in the sense in which it implies the principle of body specificity, according to which different bodily characteristics lead to corresponding differences in the way in which people construct concepts and word meanings. Classical cognitive science has been characterized by an association with the computational theory of mind. Although this association has produced highly significant results, it has also limited the scope of scientific psychology. In this paper, we analyse the limits of the specific kind of computational model represented by the Chomskian-Fodorian tradition in the study of mind and language. In our opinion, the adhesion to the principle of formality imposed by this specific computational model has motivated the exclusion of consciousness in (...) the reflection on language and, consequently, has led to the inability to account for some aspects of language functioning at the processing level of discourse. The aim of this article is to restore the role of consciousness in discourse comprehension and production processes. Specifically, we argue that the ability to produce and understand discourses is based on individuals’ capacity for navigation in space and time. We will show that the space–time orientation is guaranteed by the projection of the self, which involves a special kind of consciousness. (shrink)

We tend to seek immediate gratification at the expense of long-term reward. In fact, the more distant a reward is from the present moment?the more we tend to discount it. This phenomenon is known as temporal discounting. Engaging in mental time travel plausibly enables subjects to overcome temporal discounting, but it is unclear how, exactly, it does so. In this paper, we develop a framework designed to explain the effects of mental time travel on temporal discounting by showing how the (...) subject?s temporally extended self enables mental time travel to generate appropriate emotions that, in turn, via metacognitive monitoring and control, generate appropriate behaviours. Building on existing approaches we outline an initial framework, involving the concepts of emotion and the temporally extended self, to explain the effects of mental time travel on resisting temptation. We then show that this initial framework has difficulty explaining the effects of mental time travel on a closely related phenomenon, namely, overcoming procrastination. We next argue that, in order to explain these effects, the concept of emotion needs to be refined, and the concept of metacognition needs to be added to the framework: emotions involve an action-readiness component, which, through metacognitive monitoring and control, can enable the subject to resist temptation and overcome procrastination. Finally, we respond to an objection to our account?based on the somatic marker hypothesis?such that metacognition is not necessary to account for the role of emotions in decision-making. (shrink)

After a brief discussion of Kreisel’s notion of informal rigour and Myhill’s notion of absolute proof, Gödel’s analysis of the subject is presented. It is shown how Gödel avoids the notion of informal proof because such a use would contradict one of the senses of “formal” that Gödel wants to preserve. This Gödelian notion of “formal” is directly tied to his notion of absolute proof and to the question of the general applicability of concepts, in a way that overcomes both (...) Kreisel and Myhill’s conceptions. This paper aims to contribute to the present-day debate on informal and epistemic mathematics, focusing on what appears necessary for a better understanding of the issues at stake. (shrink)

Among the tools of philosophical work, the dialogue, as form of live "transaction" between two or more persons, seems to have its beginning and its end with Socrates. Along the subsequent development of our philosophical tradition the dialogue reappears only as literary genre. The essay aims to suggest that the live philosophical dialogue, if offered in new forms as a distributed social practice arranged and supported by the professional skills of philosopher, shows some promise of widening the boundaries of the (...) examined life. Bibliographic negligence, i.e. omission of citation of the relevant work of other researchers, is possibly the most common type of research misconduct, leading to unfair loss of priority of authorship and undermining the reward system of science. We report a case of bibliographic negligence which we recently suffered from a leading biomedical journal. The case is discussed in the context of the editorial policy of the journal and of relevant ethical guidelines. Scientific journals should develop codes of conduct for citations. (...) The expression oikoi stratiōtikoi, used in Constantine VII Porphyrogenitus as opposed to oikoi politikoi, designates all those families who were bound to military service. They, in the tenth century, were listed in various enlistment registers that were periodically updated, among which one was kept in Constantinople. There is solid evidence to argue that such an administrative practice originated in the eighth century, coinciding with a significant transformation in the enrolment of soldiers and their maintenance. A conscription procedure was devised in (...) the age of the Isaurians, which, although it is not known whether it was on a voluntary or compulsory basis, entailed the entry in the military records (in Constantinople and the provinces) of every person in charge (oikodespotēs) of the family that had assumed the military burden. This implied in later periods a strong uncertainty in the relationship between service and its performance because registration rested on an ambiguous vocabulary. The ambiguity, in fact, was rooted in the polysemy of the concept of oikos, family unit, home and patrimony at the same time. While such a notion allowed the recruitment in thematic armies to function flexibly through the wide network of the family’s cognate and agnatic structure, precisely because the oikos was also a set of economic interests, it exposed the landed patrimony of military families to splitting and erosion. This ambiguity ended with Constantine VII’s famous law of 949, which regulated the property regime of the stratiōtikoi oikoi, a regime that, as the same provision explicitly states in several points, already existed previously throughout the empire. The law provided a precise economic quantification of the assets needed for each ‘military family’ to perform the service. Historiography has generally interpreted Constantine VII’s measure as an act breaking with the previous tradition, since military service appears in it much more markedly connoted as a patrimonial burden, rather than as a personal one. However, this ‘oppositional’ interpretation does not seem adequate for understanding the concept of oikos stratiōtikos, which from the outset must have implied a profound interrelationship between the personality of the service and its patrimonial basis, since the one did not exist without the other. The Affective grounding hypothesis suggests that affective experiences play a crucial role in abstract concepts’ processing (Kousta et al. 2011). Vigliocco and colleagues test the role of affective experiences as well as the role of language in learning words denoting abstract concepts, comparing children with typical and atypical development. They conclude that besides the affective experiences also language plays a critical role in the processing of words referring to abstract concepts.

The Ostrogorski paradox and the discursive dilemma are seemingly unrelated paradoxes of aggregation. The former is discussed in traditional social choice theory, while the latter is at the core of the new literature on judgment aggregation. Both paradoxes arise when, in a group, each individual consistently makes a judgment, or expresses a preference, (in the form of yes or no) over specific propositions, and the collective outcome is in some respect inconsistent. While the result is logically inconsistent in the case (...) of the discursive paradox, it is not stable with respect to the level of aggregation in the case of the Ostrogorski paradox. In the following I argue that, despite these differences, the two problems have a similar structure. My conclusion will be twofold: on the one hand, the similarities between the paradoxes support the claim that these problems should be tackled using the same aggregation procedure; on the other hand, applying the same procedure to these paradoxes will help clarify the strengths and weaknesses of the aggregation method itself. More specifically, I will show that an operator defined in artificial intelligence to merge belief bases can deal with both paradoxes. (shrink)

Ethical dilemmas in critical care may cause healthcare practitioners to experience moral distress: incoherence between what one believes to be best and what occurs. Given that paediatric decision-making typically involves parents, we propose that parents can also experience moral distress when faced with making value-laden decisions in the neonatal intensive care unit. We propose a new concept—that parents may experience “moral schism”—a genuine uncertainty regarding a value-based decision that is accompanied by emotional distress. Schism, unlike moral distress, is not caused (...) by barriers to making and executing a decision that is deemed to be best by the decision-makers but rather an encounter of significant internal struggle. We explore factors that appear to contribute to both moral distress and “moral schism” for parents: the degree of available support, a sense of coherence of the situation, and a sense of responsibility. We propose that moral schism is an underappreciated concept that needs to be explicated and may be more prevalent than moral distress when exploring decision-making experiences for parents. We also suggest actions of healthcare providers that may help minimize parental “moral schism” and moral distress. (shrink)

The article is devoted to postmodernism musical performance. There was realized a comprehensive retrospective analysis of the phenomenon development from ancient period to nowadays. It was proved that in ancient times interpretation was explained as a form of mythological worldview embodiment; in the Middle Ages as a way of uniting man and God; in Rrenaissance as a means of harmonizing material and spiritual components of personality; in Baroque as a method of theatricality of person's existence; in Classicism as an opportunity (...) to assert the power of human mind; Romanticism emphasized emotionality and subjectivity of concerting, the unique role of master; Modernism declared freedom of interpretation. Understanding the essence of musical performance with each historical stage became deeper, was enriched with new terminological, depth of scientific and theoretical understanding. The musical performance of postmodernism as a unique phenomenon has its own chronology of formation and development, based on achievements of previous epochs, transformed in accordance to philosophical aesthetics of the late XX century. Its outstanding constitutive qualities are: anthropology, religiosity, spirituality, meditation, improvisation, humanism, dialogicity, theatricality, rationalism, intellectualism, emotionality, playing, intertextuality, polystylistics etc. The performing art of postmodernism embodies the conceptual principles of its time: pluralism, irony, collage, synthesis, the death of the author, so on. It unites, eclectically mixes different artistic traditions and views, it forms a unique interpretive vision of musical text, demonstrates openness to dialogue with different historical epochs and civilizations, aimed at both the elite and the mass audience. Structured argumentation formalisms, such as ASPIC +, offer a formal model of defeasible reasoning. Usually such formalisms are highly parametrized and modular in order to provide a unifying framework in which different forms of reasoning can be expressed. This generality comes at the price that, in their most general form, formalisms such as ASPIC + do not satisfy important rationality postulates, such as non-interference. Similarly, links to other forms of knowledge representation, such as reasoning with maximal consistent sets of rules, (...) are insufficiently studied for ASPIC + although such links have been established for other, less complex forms of structured argumentation where defeasible rules are absent. Clearly, for a formal model of defeasible reasoning it is important to understand for which range of parameters the formalism (a) displays a behavior that adheres to common standards of consistency, logical closure and logical relevance and (b) can be adequately described in terms of other well-known forms of knowledge representation. In this paper we answer this question positively for a fragment of ASPIC + without the attack form undercut by showing that it satisfies all standard rationality postulates of structured argumentation under stable and preferred semantics and is adequate for reasoning with maximal consistent sets of defeasible rules. The study is general in that we do not impose any other requirements on the strict rules than to be contrapositable and propositional and in that we also consider priorities among defeasible rules, as long as they are ordered by a total preorder and lifted by weakest link. In this way we generalize previous similar results for other structured argumentation frameworks and so shed further light on the close relations between assumption-based argumentation and ASPIC +. Emotion-processing impairment represents a risk factor for the development of somatic illness, affecting negatively both health-related quality of life and disease management in several chronic diseases. The present pilot study aims at investigating the associations between alexithymia and depression, anxiety, and HRQoL in patients with Hashimoto’s thyroiditis ; examining the association between these three psychological conditions together with HRQoL, and thyroid autoantibodies status as well as thyroid echotexture in patients with HT; and comparing the intensity of all these clinical psychological (...) features in patients with HT versus controls. Twenty-one patients with serologically or ultrasonographically verified HT and 16 controls with non-toxic goiter or postsurgical hypothyroidism were recruited for this study. Serum thyrotropin and free thyroxine, as well as thyroid autoantibodies, were assayed. Alexithymia, depression, anxiety, and HRQoL were assessed with Toronto Alexithymia Scale; Beck Depression Inventory, second edition; Hamilton Anxiety Rating Scale; and Health Survey Short-Form 36, respectively. A negative relationship between the difficulty to describe feelings and the cognitive component of depression was found. Besides, patients with seronegative HT had lower somatic anxiety than patients with HT who tested positive. Besides, no statistically significant difference was found between patients with HT and controls with regard to somatic anxiety. The present study suggests the relevance of alexithymia in patients suffering from HT, which may be intertwined with a possible state of underreported depression that is mainly expressed through physical complaints. Promoting the capability to describe and communicate feelings could contribute to psychological elaboration and coping with the disease and, consequently, to the improvement of self-management and perceived HRQoL. Hobbes's philosophical discourse is deconstructed as the interplay of the drama of individual behavior as perceived by rational agents and the detached analysis of conflict a by a political geometer . The author solves some long-standing problems in Hobbesian political philosophy (e.g., the role of glory, Hobbes' pessimism) and shows the consistency of Hobbes's attempt to derive absolutism as the only stable political association.

Thorough a detailed analysis of version III of Gödel's Is mathematics syntax of language?, we propose a new interpretation of Gödel's criticism against the conventionalist point of view in mathematics. When one reads carefully Gödel's text, it brings out that, contrary to the opinion of some commentators, Gödel did not overlook the novelty of Carnap's solution, and did not criticise him from an old-fashioned conception of science. The general aim of our analysis is to restate the Carnap/Gödel debate in the (...) Fregean heritage. We stress the way both of them try to answer, from different Fregean perspectives, to the question of the nature of logic and mathematics in knowledge. (shrink)

Judgment aggregation studies how individual opinions on a given set of propositions can be aggregated to form a consistent group judgment on the same propositions. Despite the simplicity of the problem, seemingly natural aggregation procedures fail to return consistent collective outcomes, leading to what is now known as the doctrinal paradox. The first occurrences of the paradox were discovered in the legal realm. However, the interest of judgment aggregation is much broader and extends to political philosophy, epistemology, social choice theory, (...) and computer science. The aim of this paper is to provide a concise survey of the discipline and to outline some of the most pressing questions and future lines of research. (shrink)

Au Moyen Âge, la théorie médicale de la complexio n’est pas confinée dans le domaine restreint de la théorie ou de la pratique de la médecine. Elle implique une anthropologie déterminée, qui ne concerne pas seulement la santé et le bien-être de l’homme, mais, dans certaines limites, la nature même de celui-ci ou, pour mieux dire, la manière dont la nature spécifique de l’homme s’articule avec la variété et la différence des tempéraments et des dispositions individuelles : ce qu’est chaque (...) individu dépend de la complexion qui lui est propre. Cette anthropologie médicale dépasse les limites de sa discipline et pénètre aussi la théologie, par une série d’implications, pas toujours prévisibles, qui concernent la place de l’homme dans l’univers, l’eschatologie, la démonologie et aussi la christologie. Le but de cette étude est de rendre compte de certaines de ces implications en regard de la pensée de Thomas d’Aquin. Les différents lieux où Thomas étudie la complexion corporelle – il en considère les implications dans les domaines intellectuel et moral – montrent une sorte d’assimilation de l’anthropologie médicale (indirectement galénique, mais surtout avicennienne) à l’intérieur de son horizon de pensée, constitué par la philosophie naturelle aristotélicienne et par les exigences propres à sa théologie. Why is it that the laws of war, or international humanitarian law (IHL), allow no justification for breaking the law even if where such conduct would actually produce less humanitarian harm than following the law? In introducing the concept of a humanitarian necessity justification, and complementing existing work on humanitarian exceptions to the jus ad bellum, this paper suggests that it should. It first addresses the puzzle of IHL's existing absolutist stance with regard to compliance with IHL norms; to demonstrate (...) the implications of this absolutist stance, I use three historical case studies in which actors broke the law under a claim of necessity, or a mixed concern for self and others: The Early Warning Procedure employed by the IDF in the West Bank, the paradigmatic case of interrogational torture, and the atomic bombings of Hiroshima and Nagasaki. I then examine whether the domestic necessity defense in criminal law might be transposed onto the international level, ultimately finding that such transposition is impossible given the different assumptions that operate in domestic criminal law and IHL. In further searching for an account for IHL's absolutist stance and the possibility of mitigating that stance, the paper turns to first-order accounts - deontological, consequential, and institutional. I argue that none of these accounts offers a sufficiently convincing explanation for the exclusion of a humanitarian necessity paradigm, and instead, that room should be made for some humanitarian-driven exceptions. Ultimately, the paper offers a blueprint for a definition for a humanitarian necessity justification that would exculpate an actor who violated the laws of war in the name of a greater humanitarian good. The central component of the definition is a requirement that the greater humanitarian good would be for the benefit of the enemy, rather than for oneself. Under such paradigm, the Early Warning Procedure and perhaps even the atomic bombing of Hiroshima (but not Nagasaki) might be justified, while the paradigmatic case of interrogational torture could not.
